Block Coin Inc (often referred as “we”, “us”, or “our”), a United States Company, controls and manages the Myblockcoin.io Website and NFT Marketplace, which provides “User” or “You” with the opportunity to mint, purchase, and sell Non-Fungible Tokens that represent a fractionalized or percentage ownership of a physical real Unites States rare coin stored in a secured depository by an independent 3rd Party known as the “Custodian”. In accessing and using any of the Services, you are hereby agreeing to be legally bound by the terms and conditions of this Agreement and all applicable laws and regulations including the Block Coin Inc. Privacy Policy.
I. UPDATES TO “OUR” TERMS OF SERVICE:
Block Coin reserves the right to update these Terms And Conditions at any time without notice. Registered users on the Myblockcoin.io Website will receive electronic notice of any such changes to “Our” terms of service once these updates have been made. Any updates to this Agreement shall be posted within terms. “Users” acknowledge responsibility to review the Agreement’s terms and conditions and take notice of any such changes.
II. COMPLIANCE TO USAGE AND ACCESS OF “OUR” SERVICES:
In compliance and acceptance of Our Terms, Block Coin Inc shall give you a limited and exclusive yet non-transferable and non-sublicensable access to use and display the services, including the ability to mint NFTs and access our marketplace to sell and transfer exclusive ownership of the mentioned NFT. Any software, content or material provided to the user as part of our services is granted for the sole purpose of enabling you to use the Services as permitted by these Terms.
In consideration of Block Coin Inc granting the “User” to access “Our” Services, you represent and warrant to “US” and agree that “You” are the legal owner of the wallet and all cryptocurrencies used to mint, purchase, or sell the NFT’s offered on our website and marketplace. The user is responsible for all costs associated with acquisition of all computer related items and mobile devices used to access “Our” services. You as the “User” shall grant Block Coin Inc all data necessary to complete KYC verification before receiving access to our website and services. In compliance with all anti-money laundering laws, Block Coin reserves the right to limit access to “Our” services in the event the “User” does not meet KYC verification criteria. These criteria apply but are not limited to the following: government watch lists, suspicious wallet activity and other background information obtained by our Third Party KYC verification platform.
You shall not conceal or disguise the IP address of the computer or mobile device that accesses the Block Coin Inc’s Website and Services such as the “Mint” and “Marketplace”. You use to access the Services or otherwise take actions that interfere with us correctly identifying the IP address associated the physical location from which your mobile device or computer accesses the Internet. Furthermore, use of “Our” Services shall not violate any laws or regulations of any jurisdiction whose laws or regulations apply directly to you. You are not a resident of a country that is subject to embargo by the United States or that the United States has designated as a “terrorist supporting” country, nor on any list of prohibited or restricted parties maintained by the United States.
You have not been identified as a Specially Designated National or placed on any sanctions list by the U.S. Treasury Department’s Office of Foreign Assets Control, the U.S. Commerce Department, or the U.S. Department of State; and you will not use our Website to conduct any illegal activity;
You have not been placed on any of the following lists: European External Action Service Consolidated Financial Sanctions List; EU Terrorist List; FATF Non-Cooperative Countries and Territories; Federal Bureau of Investigation Most Wanted Terrorists & Seeking Information; Bank of England Sanctions List; HM Treasury Sanctions List; Politically Exposed People List; World Bank Ineligible Firms; Department of Foreign Affairs and Trade Consolidated List;
You shall not export or re-export, directly or indirectly, the Services, the NFTs and/or other information or materials provided by Block Coin Inc to any country for which the United States or any other relevant jurisdiction requires any export license or other governmental approval at the time of export without first obtaining such license or approval. You will not reproduce, display, distribute, or create derivative works of any Collectible, including but not limited to any physical items associated with an NFT. Violations of these terms provided will immediately terminate your right to access and use “Our” Services and may subject you to legal action. Block Coin Inc reserves the right to terminate your access at any time in the event “Our” services were used maliciously or with illegal intent.
III. LAWFUL USE OF OUR SERVICES:
Users must make responsible use of the platform for lawful purposes only. Block Coin Inc reserves zero tolerance policy for defamation or damage of “Our” name or reputation or that of any of our officers, affiliates or creators. By way of example and not limitation, you may not use the services to attempt to access or access another user’s account, password or wallet. User may not make use of the Block Coin Inc platform, social chat, or social media to abuse, stalk, threaten, or otherwise harass another services user community member or employee of Block Coin Inc (including, without limitation, submitting false or excessive customer service requests, refusing to follow the instructions of a Block Coin employee, or publicly disparage a Block Coin employee or community member. This includes the act of attempting to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with Block Coin or any other person or entity on the Block Coin Team or administration.
“User” may not solicit, collect or post personal data or attempt to solicit, collect or post personal data about other users of the services which may include usernames, passwords, or any other intellectual proprietary information that may be copyrighted or confidential to any person or entity on the Block Coin team or community. The submission of “User” content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, sexually explicit, fraudulent, invasive, or racially and ethnically objectionable will result in the immediate revocation of access to the platform and all services provided by Block Coin and Its’ affiliates. The use of software that contains viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of destructive or deceptive nature that constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain, pyramid schemes or any other form of commercial solicitation, and any potential infringement that otherwise violates the legal rights of any person or entity, including but not limited to by claiming a Block Coin Inc user’s username for the purpose of reselling it or otherwise engaging in name squatting is strictly prohibited.
An act may be considered a “Prohibited Activity” in consideration to interact with the services or its users in a way that is likely to disrupt the use and enjoyment of the services by a “User”. The employment or operation of bots, scripts, or other automated tools to perform any action on the Platform, including but not limited to registration of user names, purchase of Collectibles, and/or submitting User Content; Block Coin Inc may take actions necessary to protect the integrity of the services which includes the permanent ban of a user and the user’s wallet from the platform. If you engage in any of the Prohibited Activities, we may at our sole and discretion, without notice or liability to you, and without limiting any of our other rights or remedies at law or in equity, (A) immediately limit, suspend or terminate your access to the Services; and (B) declare void any Collectibles transaction that was completed with the assistance of, as a result of, and/or in connection with such Prohibited Activities.
IV. PROHIBITED USES OF THE SERVICES.
You may be required to create an account to the Services, to save your preferences or activity history, or to complete a transaction on the Platform. In that event, you will use your account for your internal use only. In creating an account, you must provide accurate and complete registration information to create an account on the Services. We reserve the right to disable any log-on ID, at any time and in our sole discretion, if you fail to comply with or attempt to circumvent any of the account registration requirements including the KYC verification process. You may not impersonate someone else, create an account for anyone other than yourself, provide an email address or blockchain address other than your own, or create multiple accounts.
If you choose, or you are provided with, a log-on ID (such as a username and password or, another identifier) as part of our security procedures, you must treat such information as confidential. Our use of your personal information will be governed by our Privacy Policy “PRIVACY POLICY”, which is incorporated into these Terms as means to protect all “Users”. By disclosing your email address and/or mobile telephone number to create an account, you agree that we may contact you for the purpose of advising you of changes or additions to the Services, about any of our products or services, or for such other purposes as we deem appropriate. You may opt out of these communications at any time by following the unsubscribe instructions provided in the communication. Your consent to receive promotional emails, messages, and calls is not required to use the Platform, and you may limit or revoke your consent at any time by contacting us at our customer support email address. Block Coin Inc is not responsible for any telecommunication fees you incur from any emails, messages, or calls or from your use of the Services.
You are solely responsible for maintaining the confidentiality of your account information (i.e., user ID, password and/or challenge questions). You are also responsible for all activities that occur in connection with your account. Block Coin Inc has no responsibility, and will not be liable in any way, for anything done via your account or using your password (including any unauthorized uses by third parties), such as the sale or transfer or your purchased NFTs. You agree to notify us immediately in the event of any known or suspicious unauthorized use of your user account, including loss, theft, or unauthorized disclosure of your password. If and to the extent that you are permitted to and do submit any comments, ratings, reviews, chats, customer service inquiries, or other content to be posted on the Site or on the Platform (“User Content”), you grant Block Coin Inc a perpetual non-exclusive license to use, reproduce, distribute, display, modify, create derivative works of, and sublicense the User Content in any way, including but not limited to reposting that User Content on the Site without compensation to the User. This license extends to your first name and your username and profile information. All of your communications with us through personal accounts or otherwise, as well as any attachments to those communications or otherwise submitted to us (such as documents, photographs and videos) are User Content and meant for the “User’s” privacy. Block Coin Inc reserves the right to refuse to display, or may remove any User Content for any reason, at our sole discretion
V. DIGITAL WALLETS AND CURRENCY:
The Services and NFTs are built on top of the Polygon network, but the Services may use other decentralized blockchain-based protocols instead of or as well as Ethereum or other such protocols. Users can only make purchases using the cryptocurrency USDC on the Polygon Network. We may update the cryptocurrency used to buy NFTs at our sole discretion. You must associate a compatible non-custodial wallet (e.g., a MetaMask wallet) with your account to purchase, store and engage in transactions using the interface provided by the Platform. We may also update the range of compatible wallets from time to time at Block Coin’s discretion. The use of your external wallet in connection with Block Coin’s services, the user agrees to operate such external wallet under the terms and conditions of the applicable providers of such external wallet. In example, for the MetaMask wallet, those terms and conditions are available at https://metamask.io/terms.html. User’s external wallets are not operated by, maintained by, supported by, or affiliated with Block Coin Inc. Block Coin does not have custody or control over the contents of your wallet, and the private keys necessary to decrypt an External Wallet are held solely by you. Block Coin has no ability to assist in the recovery of your private keys for your external wallet.
Block Coin has no responsibility or liability to you in connection with your use of an external wallet and makes no guarantees or warranties regarding how the services will operate with any specific external wallet. Contact your wallet provider in the case that you discover an issue related to your external wallet. You are sole, responsible party for keeping your wallet secure and you should never share your wallet credentials or seed phrase with anyone. Block Coin is not liable for any acts or omissions by you in connection with your external wallet or as a result of your external wallet being compromised. In the event your external wallet has been compromised, the user agrees to notify Block Coin immediately upon discovery. Block Coin reserves the right to refuse to associate an external wallet with a User’s Account in its sole and exclusive discretion. If you attempt to associate your account with a non-custodial wallet bearing risk factors, such attempts may result in the suspension or termination of your Account, each as determined in Block Coin Inc’s sole and exclusive discretion. If you decide to transfer an asset, Block Coin Inc accepts no liability or responsibility for any such transfer, including for any loss, data corruption, or other negative impact that may occur to your NFTs or wallets or other assets when attempting to transfer assets between wallets.
Through the Block Coin Inc’s services, You may be permitted to mint, purchase and own NFTs created by Block Coin Inc that represent true fractional ownership of the corresponding physical asset held and insured in the depository owned by the “Custodian”. NFTs will be minted on the Block Coin platform by “Users” where users can then store the NFTs in the external wallet or re-sell the NFTs on the Block Coin Marketplace or any third-party marketplace that supports NFTs on the Polygon Chain. Block Coin assumes no responsibility for NFTs purchased or resold on any other marketplace. Block Coin advises users to check and verify all contract addresses before purchasing NFTs on a third-party marketplace. When you purchase an Asset-Backed NFT at Block Coin, you acquire fractional ownership of the associated Physical Asset. Block Coin assumes responsibilities for vault services which includes the insurance and placement of coins in our secure vault. Audits will be available to “Users” to ensure custody for all the assets stored at the depository. The Insurance policy for the depository is available for “Users” to review on the Block Coin Inc website.
Any anticipated profits from buying or selling BlockCoin NFTs are NOT based upon the performance of BlockCoin or any affiliated third parties, but on the value of the NFT backed assets (gold coins) themselves.
